Copyright Notice Procedure

Welcome to All West Virginia Forms, where we are committed to upholding the highest standards of copyright respect and compliance. We understand the importance of protecting intellectual property rights and are dedicated to handling copyright issues with the seriousness they deserve. Our goal is to ensure that all content shared on our platform respects the rightful owners' copyrights.

Submitting a Copyright Notice

If you believe that any content on All West Virginia Forms infringes upon your copyright, we encourage you to let us know. By following our structured procedure, we can effectively address your concerns and take appropriate action. Please submit a notice to our designated Copyright Agent at dmca@wvtemplates.com, including the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • A description of the copyrighted work that you claim has been infringed.
  • A description of where the material that you claim is infringing is located on the website.
  • Your contact information, including address, telephone number, and email address.
  • A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Our Response Process

Upon receiving a valid copyright notice, our team will promptly review the submission to determine its completeness and validity. If the notice meets all requirements, we will take action, which may include removing or disabling access to the allegedly infringing material. We are also committed to promptly notifying the individual or entity that posted the content, allowing them the opportunity to respond with a counter-notice if they believe the claim is unjustified.

Submitting a Counter-Notice

If your content has been removed or disabled and you believe this was a mistake or that you have the legal right to post the material, you have the option to submit a counter-notice. Similar to the copyright notice process, your counter-notice should be sent to dmca@wvtemplates.com and include the following:

  • Your physical or electronic signature.
  • A description of the material that has been removed or to which access has been disabled and where the material was located online before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you believe in good faith that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
  • Your contact information, including address, telephone number, and an email address.
  • A statement that you consent to the jurisdiction of the federal court in the district where you reside, or if outside the United States, to any jurisdiction where you may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.

Upon receipt of a counter-notice containing all necessary information, we will forward it to the party who submitted the original copyright notice. If they do not seek a court order to prevent further infringement of the content within a set time frame, we may restore the content in question.

At All West Virginia Forms, we strive to mediate copyright disputes with fairness and efficiency. Protecting the rights of copyright owners while supporting the legitimate use of material under copyright law is a balance we are proud to maintain.
